Article 1 - Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period within which the consumer can make use of their right of withdrawal;
Consumer: the natural person not acting in the course of a profession or business who enters into a distance agreement with the entrepreneur;
Day: calendar day;
Duration transaction: a distance contract relating to a series of products and/or services, the supply and/or purchase obligation of which is spread over time;
Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unaltered reproduction;
Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period;
Model form: the withdrawal form made available by the entrepreneur for the consumer to use for exercising their right of withdrawal;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: an agreement whereby, within the framework of a system organized by the entrepreneur for distance selling of products and/or services, exclusive use is made of one or more means of distance communication up to and including the conclusion of the agreement;
Means of distance communication: a method that can be used to conclude an agreement without the consumer and entrepreneur being together in the same place at the same time;
General Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 3 - Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and consumer. The text of these terms and conditions will be made available to the consumer prior to the conclusion of a distance contract. If this is not reasonably possible, the entrepreneur will indicate before the contract is concluded how the terms and conditions can be viewed and that they will be sent free of charge upon request.
If the distance contract is concluded electronically, these terms may be made available to the consumer electronically in a way that allows them to be stored on a durable data carrier. If this is not possible, the consumer will be informed where the terms can be accessed electronically and that they will be sent electronically or otherwise free of charge upon request.
If specific product or service conditions also apply, the second and third paragraphs apply accordingly, and in the event of conflicting conditions, the consumer may rely on the most favorable provision.
If any provision of these terms and conditions is invalid or annulled, the remaining provisions remain in force. The invalid or voided provision shall be replaced by a provision that comes as close as possible to the original intent.
Situations not covered by these terms and conditions should be evaluated in the spirit of these terms. Ambiguities about the interpretation or content of one or more provisions shall also be interpreted in the spirit of these terms.
Article 4 - The Offer
If an offer has a limited duration or is subject to conditions, this is explicitly stated in the offer. The offer is non-binding. The entrepreneur may change or adapt the offer.
The offer includes a complete and accurate description of the offered products and/or services, allowing the consumer to make a proper assessment. If images are used, they reflect the products and/or services truthfully. Obvious errors or mistakes do not bind the entrepreneur.
All images, specifications, and information in the offer are indicative and do not entitle to compensation or dissolution. Colors shown may differ slightly from actual product colors.
Each offer contains information clearly indicating the rights and obligations involved in acceptance, including:

the price including taxes;

any shipping costs;
-
the method of concluding the agreement and required actions;
-
whether the right of withdrawal applies;
-
the method of payment, delivery, and execution;
-
the period for acceptance or validity of the offer;
-
communication costs if not based on the standard rate;
-
whether the agreement will be archived and accessible;
-
how the consumer can check and correct data before submission;
-
available languages other than Dutch;
-
codes of conduct the entrepreneur subscribes to;
-
the minimum duration of a distance contract if applicable.
Optional: available sizes, colors, material types.
Article 5 - The Agreement
The agreement is concluded when the consumer accepts the offer and meets the stated conditions. If acceptance is electronic, the entrepreneur immediately confirms receipt. Until confirmation is received, the consumer may dissolve the agreement.
If concluded electronically, the entrepreneur ensures appropriate technical and organizational measures to secure data transfer and provides a secure web environment. If the consumer can pay electronically, the entrepreneur implements appropriate security measures.
The entrepreneur may verify whether the consumer can meet their payment obligations and may refuse or attach special conditions to an order if there are justified reasons.
The entrepreneur provides the following information with the product or service in writing or in a durable format:

business address for complaints;

how to exercise the right of withdrawal;

warranty and post-purchase service info;
-
the data mentioned in Article 4(3), unless already provided;
-
termination conditions for agreements longer than one year or indefinite.
In duration transactions, this only applies to the first delivery. Every agreement is subject to availability of the products.
Article 6 - Right of Withdrawal
When purchasing products, consumers may withdraw from the contract within 14 days without giving reasons. The reflection period starts the day after receipt of the product.
During the cooling-off period, the consumer must handle the product and packaging carefully, using it only as necessary to assess if they wish to keep it. If exercising the right of withdrawal, the product must be returned in its original condition and packaging with all accessories, following the entrepreneur’s reasonable and clear instructions.
Article 7 - Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, the return shipping costs are borne by the consumer unless otherwise indicated by the entrepreneur.
Article 8 - Exclusion of Right of Withdrawal
The entrepreneur may exclude the right of withdrawal for products that:

are made to the consumer's specifications;

are clearly personal in nature;
-
cannot be returned due to their nature;
-
spoil or age quickly;
-
consist of newspapers or magazines;
-
involve audio/video recordings or software unsealed by the consumer.
Article 9 - The Price
During the validity period stated in the offer, prices will not increase except for VAT changes.
Products/services subject to financial market fluctuations may have variable prices. Price increases due to legal regulations are permitted.
Article 10 - Conformity and Warranty
The entrepreneur guarantees that the products/services conform to the agreement, specifications, reasonable usability, and legal requirements. If defects occur within the warranty period, the entrepreneur will take corrective measures.
Article 11 - Delivery and Execution
The entrepreneur exercises the utmost care in executing orders and assessing service requests. Products are delivered to the address specified by the consumer. Delivery times are indicative; delays do not entitle compensation unless agreed otherwise.
If timely delivery is not possible, the entrepreneur will inform the consumer and offer an alternative. The consumer may cancel the agreement at no cost.
Article 12 - Duration Transactions: Termination and Extension
In fixed-term agreements (e.g., subscriptions), the consumer may cancel at the end of the term per the agreement’s conditions. For indefinite agreements, the consumer may cancel at any time with a notice period of up to one month.
In case of automatic renewal, the consumer must be timely informed of cancellation options and conditions.
Article 13 - Payment
Payment must be made using the methods stated in the offer. Unless otherwise agreed, payment is due within 14 days of receiving the product or service. Late payments incur statutory interest and collection costs.
Article 14 - Complaints Procedure
The entrepreneur has a complaint procedure and handles complaints accordingly. Complaints about the execution of the agreement must be submitted clearly, fully, and promptly. They are addressed within 14 days.
Article 15 - Disputes
Dutch law exclusively applies to agreements governed by these terms. Disputes are submitted to the competent court in the entrepreneur’s jurisdiction, unless otherwise legally required.
Article 16 - Additional or Deviating Provisions
Additional or deviating provisions may not disadvantage the consumer and must be provided in writing or in a durable form accessible to the consumer.
